How Are People Search Sites Legal?

People search sites are legal because they collect public and marketing data, not consumer reports. Here is why they exist and how to opt out.

People search sites are legal because most of the data they publish is already public, or was collected from sources that allow resale. They gather names, addresses, phone numbers, relatives and past locations, then package it into a profile. In the United States there is no single federal law that bans this. Instead, a patchwork of rules decides what these sites can do, and most people search sites stay just outside the strictest ones.

Common questions

Is it legal for a people search site to list my home address?

In most cases yes. Home addresses are often drawn from public records, marketing databases and other legal sources. Property records in particular are public by law and cannot be deleted. You can, however, ask the site to suppress the version it displays through its opt-out process, and under CCPA a California resident can demand deletion of the data the broker holds.

Can I sue a people search site for publishing my information?

Usually not just for listing public data, because that activity is generally legal. You may have a claim if a site presents itself as a consumer reporting agency and violates the FCRA, or if it ignores a valid legal deletion request in a state that grants one, such as California under CCPA. Speak to a lawyer about your specific situation.

Why do my details come back after I remove them?

Brokers rebuild their records from upstream feeds. They buy fresh data from other databases, public records and marketing lists on a regular cycle. Even after a successful opt-out, your listing typically reappears within a few months once new data flows in, so removal has to be repeated.

Does the CCPA apply to me if I do not live in California?

The CCPA and CPRA grant rights to California residents. Some other states have passed their own privacy laws with deletion or opt-out rights. Outside those states you can usually still use a broker's standard opt-out form, which most sites offer to everyone regardless of location, even though it is not backed by the same legal force.

Are free people search sites legal too?

Yes. Whether a site charges or not does not change its legal position. Free and paid sites draw on the same categories of public and marketing data. The paid ones simply charge for a fuller report or to unlock contact details behind a preview.
